New developments are some of the most talked-about opportunities across Marbella, Estepona, Benahavís and the wider Costa del Sol — and for good reason. But a new build is more than a fresh coat of paint, and buying off-plan is a genuinely different proposition from buying an existing home. Here is the honest ledger, both sides.
You step in early — often at the best price. Buying new, and especially off-plan, means reserving before or during construction, frequently at the keenest pricing and with the widest choice of units and finishes.
You shape the home to your taste. Buy early enough and you can often choose finishes, kitchens, bathrooms and layouts — the home is built around how you actually want to live before a single wall is tiled.
Real, legally-backed protection. New builds in Spain carry a mandatory ten-year structural guarantee, alongside a three-year warranty on installations (plumbing, electrics) and a one-year warranty on finishes. While the property is under construction, your deposits and stage payments must be protected by a bank guarantee or insurance policy, so your money is safeguarded if the developer fails to deliver.
Lower running costs, modern living. Contemporary developments are built to current standards — better insulation, aerothermal systems and high energy ratings that mean lower bills and a smaller footprint — often with communal pools, gyms, landscaped gardens and co-working spaces built in.
Your capital is spread out. Because you pay in stages as construction advances — typically a reservation fee, then around 20–40% (plus VAT) across the build, with the balance at completion — your investment is phased rather than due all at once.
You wait for completion. Off-plan follows the developer's construction timeline. If you need a home to move into or let now, a resale you can use from day one may suit you better.
You're buying from plans, not the finished article. You reserve on the strength of drawings, specifications and show units. Good developers deliver exactly that — but it asks more diligence of you and your lawyer, who should check every guarantee and milestone before you transfer funds.
The tax bill is higher than on a resale. A new build is taxed at 10% VAT (IVA) plus 1.2% AJD in Andalusia — roughly 12–13% all in once you add notary, Land Registry and legal fees. A resale, by contrast, pays a flat 7% ITP in Andalusia and lands nearer 8–10% all in. Over the price of a home, that gap is real money and belongs in your numbers from the start.
Completion depends on the developer. Timelines can move, which is precisely why the bank-guarantee protection on your stage payments matters so much — and why the developer's track record is part of the due diligence, not an afterthought.
It depends on what matters most to you. New-build suits you if you want to customise, move into something modern and efficient, phase your payments and buy with builder guarantees behind you — and can wait for completion and accept the higher tax. A resale suits you if you want to move in or let straight away, see exactly what you're buying, and pay the lower transfer tax.
